Cave Story-like platformer using Nxengine?

Just wondering if it's possible/legal to make a complete new game using NxEngine, as long as it doesn't use any of the CaveStory graphics/story content. The engine seems quite light if compared to many modern game engines and have ports to various consoles/operating system's.

it's fine however be aware that NxEngine itself is GPL which means any derivative project must also be GPL and open source. Consider whether that will impact your project before choosing it.
